Hello,

I wonder if anyone can help me as I'm very confused about this?

I petitioned for bankruptcy on 10 March 2009 and was discharged one year later in 2010. I have been looking at my credit file with Equifax and I am not sure whether my file has been cleaned up yet. If I give a list of the items, can anyone tell me if I need to contact the suppliers or is the file okay?

Halifax
default date: 27/04/2009
Status: defaulted
Date updated: 11/06/2009

Natwest personal loans
Status: settled
date updated: 14/09/2009
date satisfied: 26/08/2009

Preference cards
default date: 27/04/2009
status: defaulted
date updated: 09/06/2009

Natwest current account
status: settled
date updated: 15/09/2009
date satisfied: 26/08/2009

Natwest card services
default date: 23/03/2009
status: defaulted
date updated: 07/06/2009

I'm finding this really confusing and don't know whether I need to do anything and contact the suppliers or not about the 'defaulted' ones or even the 'settled' ones. Can anyone help please?

Thanks Big Al,

So I should only be concerned with those creditors who are either still listed as 'defaulted' or any one which are 'settled' but with a date which is beyond my bankruptcy discharge date. Is that correct?
If this is the case, all my 'settled' have dates within my 1 year period of bankruptcy, so they should be okay. I will definately send letters to the two creditors which still show defaulted though.

the settled ones will show as settled after the date of your bankruptcy, as you're liabilities are not fully discharged, until you are actually discharged from bankruptcy(that's why with with such things as benefit overpayments etc. the agency involved can still recover payments until discharged from bankruptcy, when the balance will be claimed in bankruptcy)

Thanks viki and everyone who has replied to my query. I think I will just send a letter to all of them, even the 'settled' ones as the dates they have listed fall after the date of my bankruptcy. The last thing I want is for these to still be on my file 6 years after my bankrupcty.

Hi xmas baby,

You need to start cleaning your credit file up now as if a creditor is showing default and not satisfied, ie, it's in red and not green, then you will have difficulty getting any credit. You can get certain credit even if BR is showing.

I was turned down for a vanquis credit card because of this apparently, or so credit expert say. 3 of my creditors were still showing as default.

Credit expert have sent letters to all of my creditors and Lloyds TSB have already amended their entry to show as satisfied.

You can send the letters yourself though.

Any defaults will stay on your credit file for 6 years from the date they are issued. Therefore any issued on or before your BR date will drop off after 6 years, but any issued afterwards will still be showing after the BR disappears.

Thanks for the advice, everyone.

I will contact those creditors who have still got 'defaulted', although I am a bit confused by one contributors advice about contacting them after 6 years. Surely my file is automatically 'cleansed' after 6 years anyway and there would be no need to contact the creditors after this time?

A link about updating your credit files has been posteda few times so it would be worth having a look for that. I would repost it but I'm using my phone and it's not as easy as using a PC!

Once the six years are up, any creditors still showing a default should be written to and told to remove anything after the date of the BR.

Basically the date of the default should be at the latest the bankruptcy order date or before.

All the debts should now say settled or partially settled

Hi xmas baby

The creditors who are still showing a default position on your accounts are the people who you should contact. All your debts should have been included in the bankruptcy, written off and therefore settled.
