Last Feb (6 month prior to 3 yr cut off) we started to discuss with the OR about the BI in our property. We made an offer of £5k (raised by family members) which was turned down. We then recieved letters for permission to apply to the court for a charge and we signed them. As it turned out the OR had also emailed us at the same time saying 'was our £5K offer still open as they would accept' (We didnt open this e mail until a long time later and had already accepted to ourselves that we were having a charge and had already told family that we didnt need the money) therefore we never replied and assumed that the charge was going ahead. We have heard nothing since. It is now approx 6 weeks until the 3 years are up. My question is; should we have had confirmation of the final charge and if we wanted to pay it off at a later date, who do we pay??? (I understand it has an interest of 8% and would like to save up to deal with it) Thanks

Posted - 30 June 2011 : 21:48:47 yes usually once the Charge is all complete then you would receive something from the land reg to say a charge had been placed on the property.
Just to clarify the 3 year deadline is to start any court process for possession/charge not for it to be concluded
