Posted - 22 July 2011 : 14:46:43 i am in the last five of months of my ipa after three years of payment, during this time i have been on nt tax code, at no time has it been made clear if the nt is included in the ipa, at this late stage how can i find out where i stand, i read sometime ago nt tax repayment was included in ipas |

Posted - 26 July 2011 : 19:14:45 i am presuming that because he has paid the same amount all the way through and only one amount was ever mentioned that the tax was never collected at all. This would fit with the culture at the time that the tax amount being so small would not be collected
ie they never used to collect if amount was below £50pm |

Posted - 26 July 2011 : 17:51:11 then the isuue seems to be between you. your employer and HMRC rather than you and the OR.
Either HMRC never updated the employer with the new tax code or the employer never applied it, either way you will likely be liable to pay it back |

i have only ever received a letter from moonbeever, asking for payments £124 x 36months myself and partner went bankrupt september 2008, the ipa started january 2009, my monthly tax is normally £36 monthly,at this time the only paperwork i received from the or was a form to sign and return, there was not a copy of this form provided, my partner does not pay tax.

the ipa payments have always been the same, and i have never had any paperwork,mentioning the ipa did not include the tax payments.

Posted - 26 July 2011 : 13:41:39 Ok well the facts are that you have had the extra money and spent it, whoever innocently. It is unlikely to be the ORs fault as they separate out the payments on the paperwork and show the different amounts and how long you will be paying each. But check the paperwork anyway, you should have been paying a higher amount until the first April and then less since. You always have ultimate responsibility for paying your tax, so if you have not paid it to the OR then you have had and spent it and so it will need to be repaid |

i contacted hmrc, for them to tell me the nt tax code should have ended tax year 08/09 they said myself and my employer should have received letters long ago stating the nt code had ended, can anyone be blamed for this my employer or hmrc or maybe the or, i was led to assume my tax was paid as part of my ipa, which has 5 months till completion, hmrc said i will be liable for any tax owing this seems unfair as i was left in ignorance.

i have never received such a letter, and as far as i know neither has my employer.

Posted - 23 July 2011 : 10:32:45 I had a letter from HMRC telling me the nil tax code was over and it was my responsibility to inform anyone it concerned to adjust the tax code accordingly. I think the onus is on you to see that your code is correct. |

i have of course spent this money, assuming the tax was included in my ipa payments over the duration of the ipa, so initially i have been left ill informed by th or, and i suppose this will be no defence with hmrc.

You should have paid the tax to the OR for the tax year you were bankruptcy (up to 5th april) but after that, you should have been on normal tax code, so you will have to pay that tax. Have you kept it to one side or spent it?
