Posted - 01 August 2011 : 18:04:06 hi after declaring br in march im still being hounded by rossendales for coucil tax all tho i have sent 2 letters with my br number and my land lords tennancy agreement to show nothing is mine as ive had bailiffs turn up saying they are removing goods . my husband is declaring his br on friday thank god i know its scare tactics . having wrote them and emailed them to tell them this why do they include my name on the letters they keep shoving through the doors is it because my husband hasnt done his yet and should i photo copy his br letter friday and send it on to them |

Posted - 13 August 2011 : 15:07:10 just a quick one to say husbands br went through thursday of this week sent rossendales all paper work to provide proof of both of us filing for br and also notified the council too with proof of br . lets see what happens next ! what a roller coaster ride this is |

Posted - 05 August 2011 : 13:29:08 thanks for the reply . i assumed that the coucil tax office would be informed after my br interview ? recieved a telephone call from the court yesterday my husbands br appointment had to be changed to next week (thurs) just my luck when i thought today he would be done and dusted oh well just have to keep ducking and diving another week thats not long considering hw long we have been on this roller coaster ride ! as my husbands br appointment is now thursday of next week i shall after his appointment forward both our br court letters with the stamp on to proof that we are both br to the coucil tax office and also inform them by phone call |

Posted - 03 August 2011 : 19:03:26 ok best to start at the begining, have you officially told the council that you re bankrupt, they are the ones that the debt is owed to so it is for them to recall the bailiffs |

Posted - 03 August 2011 : 11:23:58 please explain in simple terms what happens if you have been issued with one all we have recieved from rossendales is letters stating how much my husband and i owe he has 2 single letters and the other is joint one is for removal of goods to of wich i have notified them all in the property is the land lords . husbands br will be done friday morning . |

Posted - 02 August 2011 : 20:40:35 are you sure, if the debt is for council tax and bailifs are instructed then it is usually because a liability order has been made |

Posted - 02 August 2011 : 19:59:22 just had a bit of a read about liabilty orders and no we have not been issued with one . even if my husband and i are br would they still be able to issue one or is it all done with then as he has his appointment friday . i have emailed and sent a letter to rossendales telling them so . |

Posted - 02 August 2011 : 10:03:03 thanks for your reply x yesterday i sent them another letter with photo copied details of my br and our tennancy agreement and im going to email them today as ive been looking on there web site . i will inform them of my husbands br too as for this years council tax i have paid this and we are up to date in fact ive just set up a direct debit for it to go out each month all our house hold bills are now up to date and i intend to keep it that way if anything ive learnt how to save and im a very big fan of ebay lol so unless i can save or have the money for it i dont get it the bills come first as they did before but now i will never borrow on a property or have another business i dont think . good job i rang the court up to find out if anything had changed since march the fee hasnow gone up to 700 and theres a bit more paper work to fill in of which i have down loaded . makes me laugh people go br for a reason = they have no money its not an easy choice to make but i must admit since i did it in march im slowly starting to get my old self back |

It is always best to keep creditors informed of any actions/intentions. Give the company concerned a ring and advise them first of your bankruptcy infrmation, date court etc, and secondly of your husbands bankruptcy hearing date - Unless they are aware they will keep hounding I'm afraid.
If you were on a joint tenancy you will be named on any letters, you personally are not liable for any debt incurred prior to your bankruptcy but this does not remove your husbands liability for any 'joint' debt such as council tax for the prioer prior to your bankruptcy, nor does it remove your own liability for any council tax for 'this year' (only previous years council tax liability can be included in the bankruptcy)
I would also follow up the call with a letter
