Posted - 17 August 2011 : 00:15:16 Hello, Its been a while since I posted here and you experts have been so much help to me THANKS! I'm still in the midst of bankruptcy and I thought I was coping well emotionally, with a positive outlook on life etc. But today I got all angry again. Talking to my trustee about two joint mortgages with my ex-husband. The banks can't take me off as joint mortgagee unless he (the ex) takes out a new mortgage in his name only. Having said that, my trustee tells me that the banks can NEVER come to me for any mortgage arrears because of legal agreements and I am safe in that respect. I currently rent a place to live. BUT...I'm tied to that b***tard financially for as long as he takes to pay the mortgages off, which could be MANY years. Is there any way I can remove myself as joint mortgagee? When I helped him take out the mortgages I was on £36k, now I'm lucky if I get £8k. I'm thinking of writing a letter to the banks in question but thought I'd ask some advice first. Posted - 18 August 2011 : 09:28:59 Thanks. The court order doesn't say that I remain on the mortgage. I'll have to check the exact wording when I get home from work this afternoon, but the fact that my bankruptcy would ruin his credit rating is an excellent point. Obvious - but I hadn't looked at that side of things! |

Posted - 18 August 2011 : 07:40:22 If the court order stated you remain on the mortgage I can't see a way out of it BUT by you being bankrupt your ex may well wish to have them in his sole name because you will be ruining his credit rating. |

In answer to your question I have not paid the mortgage at all for 4 years and not lived there for 5. I still get lettersHe now rents the property out I think. Well both properties actually. Where do I find details of the bank ombudsman for this sort of situation. I thank you for your advice because I never knew that was an option for help and advice. Cheers, Widge :) |

The trustee is not a bank so can only give generic advice
write to the bank explaining all the problems you have had with your EX.
how long you have not paid the mortgage or lived in the addresses.
The fact that you have no interest in any of the properties
reminding them not to release your new address
believe it or not some banks do have compassionate sides, you will also find the bank ombudsman helpful.
