Posted - 20 August 2011 : 17:10:24 personal bankruptcy due to none payment of council tax. house was sold by insolvency company three months ago and i have heard nothing, I have over one hundred and twenty thousand pounds of equity on this property, insolvency say they dont have actual figure of the debt i owe but is between twenty thousand and forty thousand including their fee.. They also failed to maintain my property and allowed it to be vandalised, one bathroom in property destroyed, conservatory badly damaged, windows smashed, the insolvency got a 3rd party company to remove conservartory and bathroom, reducing my property valuation from two hundred and eighty thousand pounds to one hundred and sixy five thousand pounds, they put the house up for sale for offers over 165,000 and we believe it was sold in the excess of 200,00 I cant find anyone in scotland whom is willing to help recover my equity due to me.. please help.. |

FRom what you are saying, I am very surprised that you were made bankrupt in the first place as it sounds as if you were not, and are not, insolvent. Your home is worth more than you owe. If I were you, I would start by contacting The Accountant in Bankruptcy as he is the government official who would have initially been responsible for the bankruptcy. He can be contacted on 0300 200 2600. The Insolvency company that was appointed to deal with your assets and home have a duty of care and should treat you fairly, which it sounds as if they have not. Find out which Insolvency body regulates them and contact the regulatory body complaining about the way your case and you have been handled. You could even just complain to R3 which is the main regulatory body for Insolvency Practitioners. Let the forum know how you get on.
