Posted - 22 August 2011 : 23:15:35 If your husband goes bankcrupt whilst you are still married and puts in his bankruptcy a joint loan, would you still be liable to pay any of it back? We have since divorced and I have now remarried but am being chased for the outstanding debt |

Posted - 23 August 2011 : 17:28:01 It doesn't matter whether it is secured or unsecured, you are liable for the debt and it is up to the company whether or not they freeze interest and charges.
Speak to them about it and tell them what you can afford to pay and set up a repayment plan.

Posted - 23 August 2011 : 16:07:36 This debt has ben passed to 2 debt colleciton agencies and now the third one is charging extortionate interest payments. I have asked them to freeze the payments but this isn't an unsecured loan so why can't they do this?? This debt has now tripled, which basically means I will never be able to pay this off in my lifetime. Would I have the right ot reduce the payment on this? To what I can afford?

Posted - 23 August 2011 : 06:44:48 You are both jointly liable for the full amount so if you cannot make the contractual payments you should approach the creditor and come to some arrangement with them.
