Posted - 22 September 2011 : 13:58:36 Like most people I guess, I read through the various topics on here, as some are quite enlightening regarding my own situation. However, I am confused in respect of AD.
I have just seen a comment that AD's are only shown on the insolvency website up to three months after the discharge. I actually didn't check whether my BR was discharged until some considerable time after the 12-month period - hence the reason I'm assuming it didn't show - so I thought I probably hadn't had the AD, given that I have not been in a position to clear any of the debts. I also assumed that if I had had the AD, I would’ve heard from Trustee to this effect, but that has not happened.
I obviously don’t want to incur further Court costs at this stage in obtaining any copy of the AD (I don’t know how much it would be anyway). Does this mean that the creditors can revert back to me for the debt? Also, I have noted from my Credit Report that one of the creditors has stated the account to be “satisfactory”. Is this because they are aware of an AD?
I am most definitely confused.com.

Posted - 23 September 2011 : 12:04:55 Thank you for your answer - it has cleared up most of my confusion. However, without wishing to sound silly, is that the end of it all? The Trustee is still pushing for me to sell my property (jointly owned with hubby who wasn't bankrupt).

Posted - 22 September 2011 : 14:43:43 If you get AD you don't get any notification from the OR. The entry on the insolvency register changes to show that you are discharged and this stays online for 3 months from the date of discharge.
To buy a copy of the discharge certificate you need to contact the court where you were made BR and there is a charge of around £70 (I can't remember the exact fee).
The creditors can't chase you for your debts. If they ever contact you give them the details of your BR.
Regarding your credit file, this was most likely updated when the creditor was made aware of your BR.

Only when the last tree has died, the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.
Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side. |
