 is it possible for my partner who is Latvian to go bankrupt ?

is it possible for my partner who is latvian to go Bankrupt in the Uk? He has lived and worked here for almost 2 years with me and has recently become unemployed. He was a guarantor for one of his friends in latvia for a flat. The person who owned the flat has dissapeared and the Latvian court has ordered my partner to £ 20000 because they can not find him!! No sure where we stand with the bankruptcy. Latvia is in the EU

FYI please find attached the wording regarding foreign creditors and bankrupts taken from The Insolvency Service Guidelines.

Do debts owed to foreign creditors fall into my bankruptcy?
Yes – all of your creditors in the world are able to claim in a bankruptcy being conducted in this country. There is a provision in insolvency law preventing creditors in the bankruptcy taking action against you in England and Wales whilst you are bankrupt. Foreign creditors will, in practical terms, not be stopped from taking debt-recovery action against you in their own country, as the court in this country cannot restrict their activities abroad. However, if a foreign creditor does start debt-recovery action abroad, you should explain the position and the foreign court might stop the action in view of your bankruptcy. If not, the foreign creditor may try to recover their debt from foreign assets which the trustee is unable to deal with.

Hi Tony.1

Yes is the simple answer. Your partner has been living in the UK for over 6 months and is entitled to make himself bankrupt at his local County Court that has bankruptcy jurisdiction. You will also be pleased to know that ALL his debts throughout the world will be included in the bankruptcy.
