have just got a court date for me and my husband to petition for bankruptcy and I have a couple of questions about the actual day itself.
1) Do we need to dress smart? Presume it looks better if we do
2) Do we actually go in front of a judge? From what I'd read I thought your case notes are taken into the judge. But when I called the court to book the actual hearing they inferred you actually go infront of a judge (gulp).
Can anyone fill me in on what to expect.
I'm shaking!

I'm relieved that we've finally got a date but petrified by the same token.
What happens to your £700 if the judge doesn't/won't make you bankrupt?

Hi Sarah,
Your court visit will be rather surreal but a big anti climax. You'll part with your £700 each to the court clerk ( ) then wait to see if the judge signs your papers or wants to see you. Great post from Daniel which sums the proccess up. We were in there about 20 minutes in total & we didn't need to see the judge. A nice smiley lady came out with our paperwork & said we could go. We walked out & that was it! I think the worst part for me was being in a court, even though it was just an office block, as the environment was so alien to me.
We dressed 'nicely' as that was the way I was brought up.  LOL but it really wont matter.
Seeing the judge really depends on the day, if it's busy, who the judge is etc. Remember that you are just another person in a busy day & they are not there to 'judge' you, they are there to do their job.

Hi Sarah
As for dress you can go in your casual clothes whatever you feel comfortable in, whether you see the Judge depends sometimes which Judge is sitting although at some courts you never seem to see a Judge at all, however if you do the Judge will mainly ask you just two questions, 1) Have you had any advice on going bankrupt, and do you understand the implication of being made bankrupt should he/she make the order. If you answer yes to both questions and he can see you cannot pay your debts as they fall due the order will be made, the whole scenario about 5 to 7 minutes, you will wonder as to why you had to pay £175 times 2 just for that, so dont worry |
