Posted - 28 November 2011 : 01:13:55 where to begin im 25 i started a small business 2 years ago and it seemd to be going ok untill a mixture of events i hadnt thought of happend i had 8 thefts from the site of which my insurance after the 3 wouldnt pay out so i had to bare the cost i tryed improving security even with myself staying in a caravan on the site randoms times of the week.any way it has been a a struggle i have had payment plans in place with alot of my creditors and they have been reasonably happy i have a couple of very large creditors also a person who i lease itmes from has already threatening me more than once i had to get solicitors involved to try put the wind up him, however i cant afford the solicitor any more and have been threatening again and i quote " dont even think of going bankrupt i will have you one way or another when u least expect it and your family ill get my money" now i called the police and they said it was civil as i owed him money im really concerned about it i worried about looking into the possibility of bankruptcy i have tryed getting a loan to consolidate some of the debt to carry on but have declined, to top it off for the last 2 months i have had some one else to do my work as i had an accident on the site casuing a spinal injury its not looking any better looking at an operation in the new year i can barely walk let alone work its built up to much i have days with out sleep in fear of the next day who will call, what will they do?
i have no assests as i would deem assests i rent the site i rent the buildings i rent the equipment with a view to purchase
with the losses i made last year form the thefts and the continuing bills i would say in the region of £80,000 if the lease phurchase is included for the price set my the leasee and other hp finance then its in the 180,000k mark
due to my heath not getting any better i have decided to stop trading completely i have some one who is going to take over the site and start trading them selves as a ltd using the former name i traded as if they can or would it complicate things they asked could i give them verbal advice as such to the processes i did considar selling the buisness however after consaltation over the value there is no value excpet possible £1.00 for good will.
i worried if i do go bankrupt as i see no other option in the future can i still set up a business , can i be a director ?? what about the extended orders worried about those ive done nothing i can see worng i tryed getting out the mess but with my health have failed what do i do about the threatening behavior how will the bankruptcy affect me future wise can i still trade any ideas any help ideas welcomed how long does the process take

Posted - 30 November 2011 : 20:10:46 the next sentence after i dont always agree was i agree, thats was my point kallis3, and to be honest there was no need for your last reply, as i said before, im sure no one on here thinks its a cowards way out, in away you missed a valid point, that someone has gone out and asked a general opinion on BR, research, which if i remember correctly i had to fill a sheet in on the stigma when i went BR in 2009, ive done no different. please read my other posts in other threads there honest and even say this is a good forum with plently of people who can help you but that never got an i agree, if i have in any way brought distress to you burgk im sorry, i dont think il be getting an opolgy from either of the 'experts' or am i to be proved wrong??? |

Posted - 30 November 2011 : 13:45:54 negative comments could worry new posters?? and what is the too same 'experts' harshly replying to a perfectly innocent and 100% honest reply saying to new posters, people starting on this forum?? as voters we feel let down by politicians who bend the truth, lie, we seem to want the truth, i told the truth and i told it from experience. il never swear, use inapropriate comments on this forum, but i will tell people the truth, if you feel its better to lie to them/us then by all means ban me from here.just as an extra point to kallis3 who stated 'i dont always agree with experts on here' what does the next sentence say?? my point exactly |

Posted - 30 November 2011 : 12:12:52 Same here - a lot of the people looking in or just starting on the road to BR are scared to death so to be told that some people are likely to look down on them is not helping the situation.
I don't always agree with everything posted on either this forum or the sister forum and will say so, regardless of who posts it.
I do agree that you should word your posts carefully.

Posted - 30 November 2011 : 10:21:08 my post actually said BR does help, of course your going to agree with jan, forum expert and forum admin!!! should we not be allowed to tell a situation like it is? afew months ago i had a reply to a comment saying people shouldnt moan about how much it costs to go BR, from someone whos never been in that position? but it proves my point how people view the situation, that never got flagged up or a response from 'experts' maybe because he was an expert too?? |

Posted - 29 November 2011 : 07:53:29 That's as maybe but I don't think you should post that on here - most people are worried to death about declaring BR and the stigma (thankfully not so bad now) attached to it without worrying what people will think of them.

Posted - 29 November 2011 : 01:54:27 im sure no one on here will say that about BR kallis3, but being honest here i have asked quite afew people about BR and the responses range from they should be made to work it off to they should be sent to prison!!! these are people who havent had exposure to the situation or know how frightening it can be but its still their view. |

I suggest you have a word with one of the experts who post on the forum, you can find the details under the experts link on the left hand side of the page. The advice is free and will certainly point you in the right direction.
Nobody on here will ever say that BR is the cowards way out - for some it is their only option.

Posted - 28 November 2011 : 02:23:39 bankruptcy definatly helps with the sleepless nights, believe it or not!!! once the fee is paid at court thats it, some people will see it as the cowards way out but these are the people who havent been through it mate, think about it like this, if you are already missing payments and getting letters off firms, making 5 pound aweek deals with them, what do you think your credit rating is??!!! thats not having a go at you its true, was for me, and for everyone else who owns money mate, theres no law against debt and theres no law about you cant go bankrupt, it helped me, took a massive weight off, as for the guy who will get money back one way or another well i cant help there mate, cant be a nice feeling though, unless you get lucky, take one punch and a copper sees him, it will be on record then. its off your record after 6 years then you start a fresh, with no debt. |
