Posted - 27 January 2012 : 13:24:26 I'm currently in an IVA - i'm looking to sell my property but the equity in it is probably only around £3,000. I'm thinking of filing for bankruptcy but would I lose the house? By selling the house I just want a clean break and not have a mortgage hanging over my head, I don';t stand to make any profit on it. Can someone give me some sensible advice?

Yes I believe I need to send a valuation and a copy of my Mortgage Statement to the IVA company. I'm just thinking of the hassle selling the house etc and the estate agent fees and solicitor fees.
My IVA company haven't actually got my RX1 form which I believe they need?

As you are a homeowner, then your Insolvency Practitioner will have to give you permission to sell your home whilst you are still in your IVA.
I suggest you speak to your IP regarding your plans.
Do you want to sell the house? Or keep it? You ask whether you would lose it but you don't want the mortgage. If you declare bankruptcy, then you wouldn't necessarily lose the house, but you really need to speak to an expert to go over your situation.
