Posted - 05 April 2012 : 18:34:52 the problem is my partner went bankrupt last year. he included his flat on the official rec paper work and then had it reposseded half way through the year. his ex girlfriend is joint morgage (she walked out leaving him to pay morgage and also is in very bad debt) the morgage company sold on the house but there is 22k outstanding. he has not been contacted by the morgage co' now they know he is bankrupt but his ex phoned him saying he would still have to pay and we are worried that if we marry as I own my own home and have a very small morgage then his previous morgage co' will put a charge on my property and start to try and take him to court. the official rec have told us not to worry but to be honest no one can say 100% that if we marry then the morgage company wont start getting funny. he will never go on my morgage or have a joint account and the offical rec know we live together and all of our outgoings. he is tied in for another 2 years to a very small payment plan to the offical rec.

Posted - 06 April 2012 : 08:26:12 Any mortgage shortfall will go into the bankruptcy and his ex GF will need to pay it or find a solution for her own debts.

Your partner is not liable for any shortfall if he is bankrupt but his ex will be.
If your house is in your name then it should be ok.
