 How do I declare bankruptcy and can it be joint ?

How do I declare bankruptcy and can it be jointly with my husband whom I'm separated please help me

Hi there, and a warm welcome to the forum.

Unfortunately you can only apply for bankruptcy in you 'sole' name. Your bankruptcy would contain all your unsecured debt in your sole name, together with any joint liabilities you have in joint name, for the whole amount ie if you had a joint loan for £10,000 it would be stated as a debt for £10,000 not half. Your filing for bankruptcy including the joint debt would not remove the other persons liability under the joint debt, they would still have to pay it, or consider bankruptcy themselves, or another debt solution.

I strongly suggest that you contact myself or one of the other experts here on the forum, via the experts tab on the ledt hand side of the screen, as there are a number of questions we would need information on before we could advise you that bankruptcy was the best option in your particular personal circumstances - such as debt level, income, whether you own a property - a chat would also put your mind at ease on the process and what the bankruptcy will mean to you personally.
