Posted - 26 April 2012 : 12:54:37 Thank you Jan, Perhaps you could help me further? The defendant in question died intestate. He left behind a property which he had a joint interest in with his wife. She wants to know if the charging order will be removed because he is dead or whether it would remain until such time as she sells or remortgages.Is there a process that she can go through to get the charge removed?

Any debts will be paid for out of the deceased's estate and if there is no estate then the debt will die with them.
