Posted - 25 April 2012 : 19:08:07 After a successfully completed iva 4 years ago if I was to make miselling ppi claim against the same bank my iva was with, but the mortgage was not part of the iva. Is the bank still allowed to keep the payments if I win once I put a claim in for PPI? |

If the PPI you are reclaiming was on your mortgage it wouldnt have been included as a debt in your IVA anyway.
The general school of thought is that banks are looking for ways not to pay out PPI and using IVA's as one! Keep all your correspondance between RBS so you have it as evidence in case you do need to take the case to the FSO.

Posted - 25 April 2012 : 20:22:03 Thankyou for your expert advise i was concerned as the customer service manager said thats what banks were doing and only giving me funds thats were left once they thad 100% of there debt back which as you can imagine the ppi refund would not be enough to do that, its just that rbs are asking for all my iva paperwork and although partly my fault the iva was so stressful i havnt got another fight left in me, but feel very strongly with what thay did with the ppi on my morgage. i was contemplating withdrawing my claim but with a bit of luck and patience i may have a good outcome although its only a small claim as morgage was only with them for 3 years then i had to remorgage with another provider to enter into my iva as i did a full and final payment iva with equity in my proprty.

Posted - 25 April 2012 : 20:07:58 Hi Scott.dl and welcome to the forum.
If you have completed your IVA, your right to reclaim mis sold PPi is not affected and if you are successful a creditor cannot offset any repayment to you if all of you debts to them are already written off as they would be due to your completed IVA.
If a creditor does try to retain any repayment you can make a complain to the Financial Service Ombundsman, for them to investigate the matter.

Posted - 25 April 2012 : 19:31:23 thankyou for your reply but i spoke to a cutomer service manager at debt free direct and she advised me that the bank will only keep any funds you are awarded as the debt still shows although they argree for the sack of the iva that they show it settled on my credit report....its so confusing as i dont want to be greedy as i was very grateful they agreed to the iva a am bit upset my ppi was sold wrongly to me in the first place

If you successfully completed then you should be able to claim. Hopefully you get to keep the money but I'm not 100% on that.
