Posted - 02 May 2012 : 16:45:44 My husband and i split last year. The keys to the property we jointly owned were given back about 3 months after he walked out. He declared himself bankrupt in January this year, and i am now being chased for the shortfall on the mortgage as it was in joint names and a secured loan. I cannot afford to repay the total debt as i have other debts that i incurred when we were still together due to him being off work long term sick. I am currently working, but am having to rent privately and have a 16 year old who is currently still in full time education. I have enquired about going Bankrupt, but am being told i need to pay £750 for the privilege by the CAB, and other company has said they charge £590 tro do everything for me. I can't afford either of these costs at the moment, and cannot afford to do an IVA either as the total debt i have been left with is in excess of £70k. I need some urgent help, as i am getting very stressed about this. My ex has said that he got help to go bankrupt as he wasn;t working, and now i am left with everything which i think is totally unfair........Please help me..... |

Do it yourself. it's easy 2 forms 30 pages in total and 2 hours at court. That fee probably wont include court or OR costs!
I handed in my petition and paid.. left court walked around town. Had a subway mozied back and when I got there to the public counter It was all done. The bankruptcy was done whilst I was eating my subway!
Don't get stressed. If it's one thing I've learnt is that when you start talking about bankruptcy companys back off. Sure they can try and take legal action against you but anything will be ruled out by your actions anyway.
I had 3 debt collection companys ask me to send the confirmation within 30 days and they put it on hold. But that's what the OR does as they ask you to list then all in your statement of affairs.
I was petrified last night and I didn't sleep a wink. I thought I would be shunted away because I can not write good and I was worried my fee would be taken and I would have to save again.
But the clerk was lovely - all my forms were right I didn't have to redo any and now looking back at today I don't know what I was worried about.
I am debt free. I will sleep like a baby tonight! :) |

Posted - 02 May 2012 : 18:02:08 I am on income based JSA and also ESA and I paid the £700. I was aware that I could just pay £525 but I didn't want to.. sounds weird but I've just been protected against nearly 40K of debt. so £700 is nothing. I saved it from the money I never paid my debtors. |

As Jan has said, you may get a fee reduction which would bring the fees down to £525. Speak to the CAB or an expert on here for advice.

Sorry to hear of your problems.
It's actually £700 to go bankrupt and you can do it yourself without resorting to a fee paying company.
Take some free advice from one of our experts (their details can be found on the left hand side of the page) or go to CAB and see if there is anyway you can get help with the fees.
