Posted - 04 May 2012 : 16:01:04 I have been landed a very large tax bill over £400,000 mainly due to interest charges over nearly a 2 year period due to a ex friend making deposits from his business into my account. HMRC are making me pay the bill regardless of any details I have given them. My question is whether it is better to go bankrupt myself or let HMRC petition to make me bankrupt. What are the disadvantages or advantages for both. |

Posted - 04 May 2012 : 17:25:42 If you get a bankruptcy restriction order then you can have your bankruptcy extended, this could happen whether you were made bankrupt by HMRC, or you made yourself bankrupt, it makes no difference.

Posted - 04 May 2012 : 16:51:39 Thank you for your answer, I was given advice that it is best to go bankrupt rather than being made bankrupt as if made bankrupt they can extend it up to 15 years, is this correct.

You wouldn't have to pay the court fee of £700 if HMRC make you bankrupt, other than that, there are no differences with the way you will be dealt with.
