Posted - 14 May 2012 : 18:02:12 I was declared bankrupt on 17th April and had my interview with official reciever which seemed all ok. Today I recieved a letter from the insolvency service regarding my car.. It an old car valued at £350. They are saying I need to send them details of a third party offer for my car and to give them the name and address details.. If I don't get in touch with them by 22nd may they will arrange to collect my car???? I need to know what does all this mean? I'm guessing my car has not been exempt from bankruptcy.. Not sure if anyone can help answer this as I'm baffled ?

Posted - 14 May 2012 : 22:52:04 Hi Lin, have a read of this link
http://www.insolvencydirect.bis.gov.uk/freedomofinformation/technical/TechnicalManual/Ch25-36/Chapter30/Part%206/Part%206.htm
It covers the reasons why a vehicle may be treated as exempt or not |

Posted - 14 May 2012 : 22:24:51 I explained on my bankruptcy forms that my car expenses are paid for by my mother, tax insurance, petrol and repairs.. She is 75 yrs old and I take her to hospital appointments and shopping.Im on benefits due to medical reasons and also rely on my car to attend my hospital appointments and visit my mum and check on her.. Maybe the above reasons are not valid in bankruptcy.. Thank you once again for your help..

Posted - 14 May 2012 : 19:19:05 more likely, it is down to the individual circumstances of the case rather than the OR, Cars are absolutly the property of the bankruptcy first and formost and automatically unless there is a reason to exempt them, if there is no reason then they remain property of the bankruptcy |

Posted - 14 May 2012 : 19:10:28 Sometimes the OR will quibble about a car and can take it off you.
It's all down to the individual OR.
