Hi Angela,

Well I too was very stressed out going to court, but I shouldn't have been as it was perfectly fine. I filled out some forms, waited in queues and signed the bankrutcy forms and paid the BK money and that was that. Didn't even see a judge as is fairly usual from what I hear. All in all probably took the best part of a morning. As far as the OR, I received a phone call from her a few days later all on the phone for about half an hour and she asked me about my gambling, but didn't make a big issue of it. I can't remember whether she mentioned that I might get a BRU, I think she did, but luckily for me, I heard nothing more and was discharged after a year, that was March 2010. I must admit it was the gambling issue which made me so nervous about the whole bankruptcy thing in the first place. I thought they would come down really hard on me, but my fears were unfounded at the end of the day. I'm in no way condoning gambling, but sometimes we can be a bit too hard on ourselves and it is what we learn from our mistakes that matters.

Try not to worry as I'm sure you will be fine. Let us know how you get on.

hi, was about 18k small amount on catalogues, but majority credit cards an loans due to spending most my wages on gambling some months. While im responsible for my own actions, i do feel that the banks, credit card providers make it too easy to borrow an increase limits quickly then when you ask them for help they refuse to help and keep adding stupid charges. I too did seek counselling which the OR was happy with an do feel ive learnt from my mistakes and dont care if i never have credit again, just want a fresh start. At about 3 1/2 months in, they did write to me with a copy of my bank statements, questioning any big amounts which i quickly an honestly replied to then that was it and nothing since. While i dont want a bru/bro i feel that the main thing is having the fresh start with no one chasing me anymore. I was told that if i do have a bru it may be for 3 or 4 years but bankrupcy remains on your file for 6 years anyway and even if i could get credit i dont really want it anyway so im not too worried about that, thats my outlook on it anyway. When at court, the clerk just checked through forms, took the BR fee then i waited half hour or so while the judge stamped the forms, the clerk called me back to give me my copy an that was it, then i went straight home to wait for my phone call a few hours later. Regards Anna :)

Anna, thankyoufor sharing that with me, feel a bit better, can I ask u how much debt you were in and how much was caused by gambling

Anna Posted - 31 May 2012 : 16:27:44
Hi Angela, the majority of my debts im sorry to say aswel were through gambling and borrowing to pay bills. I hesitated an was so worried about going to court and my OR interview, really worried! Now i only have 10 weeks left till automatic discharge, its gone so quick. Court itself, the clerk was friendly and you dont have to see the judge, looking back now it was nothing to be worried about. I had my phone call off OR however i did have to have a face to face interview which lasted 3 hours where i explained about gambling and borrowing etc and ofcourse going through rest of form, expences etc. I was totally honest which she then thanked me for and she was really nice. She did say id maybe have a bru but as yet nothing and not long left. Gambling isnt something i would ever do again, this whole experience has been stressful and has changed me, just looking forward to a fresh start. So i know your worried but it'll be ok an just be totally honest in your interview wether its phone interview or face to face, they dont judge. Hope this helps :)

Hi Angela,

Well my gambling debts were for around 10k, all from credit/debit cards. Not a huge amount, but enough all the same and when it comes to bankruptcy it's not always about the amount but how you came to that debt in the first place that matters. i would definately tell the OR that you have sought advice on your gambling but it might be worth also having some counselling through the NHS, which is what I did. It can't hurt at the end of the day and shows the OR that you are serious about tackling the problem. You will also most likely be banned from any local (or as in my case, nationwide) casinos, which will last indefinately and not just for the period of your bankruptcy. As far as housekeeping amounts go, I put down £250 for a single man and that was accepted. I didn't go over the top with the expenditures but at the same time I was realistic and put everything down. If they reject it you have at least tried and the likelihood is that they will accept it unless it seems a really exageratted amount.

Hi Angela,

I too had debts incurred through gambling and this was the reason I delayed applying for bankruptcy for so long as I was scared of what the OR would think or do. In the end it wasn't such a big issue although I am annoyed that I incurred all this debt through gambling in the first place. I did list it in my statement of affairs and when I spoke to the OR they did bring it up but they didn't judge me and seemed happy when I mentioned that I was going to counselling. I thought I might have got a BRU because of the gambling debts but I was lucky and just had the normal 1 year bankruptcy. I think if you can show you are doing something about the gambling problem, they are more likely to be lenient with you.

Good luck

If you are insolvent and bankruptcy is your best option, then the judge won't reject your bankruptcy. However, please speak to an expert for advice if you haven't done so already.

Hi,could judge deny bankruptcy. My total debt is 26000 ,some through gambling but don't know how much. This is off about 7 year ago but have been making token payment of 1 pound for 4 years.most have been passed to other r debt companies. Will o r be able to go back and find how much was spent on gambling.I feel terrible for what I have done and just need a fresh start
I have not had any more credit since these apart from overdraft

Hi Angela,

If your family/friends gifted you the money, or if they have now written the debt off, then you do not need to list them in the creditors section.

However, I advise you write your whole story and how you took the money from them to pay your bills after the gambling in the section at the end of your statement of affairs, and also explain exactly what happened when you have your official receiver meeting.
