Hi all, I am a first timer here so will try to keep my question as simple as possible.
My wife and I went Bankrpt 17 Sept 2011 My wife entered into a NT IPA in Dec 2011 and that ended in April 2012. We have since recieved a new IPA to start on 29th June 2012 for £248 which we just can't afford! What would you suggest?
AND
Can they issue a second IPA 2 months after the first one closed?

Thank you so much to anyone who takes the time to respond!

Also, an NT coding shouldn't affect your tax credits, if thats whats happened?

Is the £248 the same amount as the NT IPA?

Hi Darren,

A nil tax payment is different to your IPA.

If you have any surplus over £20 during the 12 months you are bankrupt then they can set the IPA up during that time.

Unfortunately you will need to contact the OR as you are disputing the IPA, so it may be that you need to do another income and expenditure.

I don't think there is any more advice I can give you, but please feel free to contact me on the main VB number.

Hi Viki, Thank you for your reply and sorry for my late response.

Our finacial circomstances havent changed since we signed the first IPA which ended on 5th April. In Fact our situation has worsened as our tax credits have stopped and we owe an over payment (through no fault of our own)

We have never signed an IPA for £248.

I was looking for the answer for my problem without asking my OR as she believes that we should pay that amount and get us to sign a second IPA? Surely if we were still under the contract of the first IPA and then had a surplus income surely she would implement a variation and NOT create a completely new contract?

please please help we are at the pulling our hair out stage!!

Thank you so so much, Darren

Hi Darren,

Have your circumstances changed recently? Or are they to change in June?

Did you sign an IPA for £248 at any time.

If you are unsure, then contact the OR for clarification. It seems that they think you have a surplus.
