The caller would like to know what is legally classed as the 'date of service' for a statutory demand.

As the OP has never responded since, we will never know until they do what method was used for delivery.

If the OP is reading, and your answer isn't fully answered, please pop along to the justice website, where all scenarios for delivery are laid out.

Thanks Daniel.

Ascend may you find no resistance
Know that you made such a difference
All you leave behind will live to the end
The cycle of suffering goes on
But memories of you stay strong
Someday I too will fly and find you again

A date of service would normally be the date the debtor would have been deemed to have been aware of the Statutory demand if the demand was not delivered by hand to the debtor, normally known as substituted service as some debtors will avoid accepting such a demand. If it was sent to the debtor by first class post the date of service would normally be on the seventh day it was sent, or if it were advertised in the press the date of service would be the date the advertisement first appeared.

I know you weren't - it was just a figure of speech on my part.

I wasn't trying to throw anything at you.

It was also me publicly explaining what Id written, in case anyone else had read it wrong.

I did not read it as disrespectful - I've had far worse thrown at me on various forums and we are all entitled to our opinions.

No apology was really necessary.

Or did read it the way I intended for it to come across?

Does that mean apology accepted?

I have just re read this thread, and realised that one of my replies could've been read in two different ways.

I wasn't trying to say that Niobe was presumably inaccurate! I was trying to say that 'presumably' isnt accurate.

Please Niobe accept my apology if you read my reply as disrespectful.

I dont think it applies to just bankruptcy either.
I was merely posting an accurate source of information for the OP.

I was merely posting my opinion as to the date - I'm not a bankruptcy expert.

Hi Andrew, for an exact date please check the justice website.
Niobe, 'presumably' isnt very accurate.

Unless corrected oterwise, I would still say that it is the date you receive the order.

Depends on the method used in receiving the demand.

Its quite clearly laid out on the justice website.
