Posted - 14 June 2012 : 19:20:16 Hi,I am so stressed I cannot think straight,my husband and I and son had a business after 16 years because of the recession had to put in the hands of receivers, Unfortunatley it has not stopped there,my husband managed to get a temporary contract employment,I work part time,but suffer with chronic health problems,so in and out of hospital all the time,we have so many debts including two properties abroad bought when our business was thriving,unfortunately one of these we have never paid the mortgage on as we purchased it off plan,and we were never allowed on to site till completed,the company we bought off went ponto,and we are now being chased for mortgage debts in excess of 240,000 pounds,,we also have another property in Spain with about 2 months in arrears,my husband had to do a DMP about eight months so when things got really bad,and to had insult to Injury my CCard had 15000 pounds owing on it,my bank has only just this week swopped that to A loan for me,as the interest was escalating,and then bang this letter arrived yesterday the Spanish bank have passed the debt overto an English debt agency and they want the full amount in 5 days or else £240,000,I did write to them at least 6 years ago explaining the situation and a English solictor can back me up on this,but they have chosen to ignore and put. MAsses of amounts of interest upon interest without telling us.We think we have no alternative But to go BR,but I am concerned about my son,his name is on the properties abroad,but they have not included is name on the paperwork sent,also he has just set up a sole trader business,and has an interest only mortgage,and is worried that if we go BR,it will affect him also.i really do not know what to do.
Could you advise us please

Posted - 16 June 2012 : 20:03:41 Although got an appt with CAB office on Monday,we have spoken to a paralegal duel solicitor who is Spanish/English who has said he can possibly help us,To be fair he has told us to get in touch with him again after we have spoken to CAB on Monday. He reckons 4 to 5 hours of his time should get the problem in Spain sorted.So at least I have two lots of experts going to look at this for me. Also my husband rang up debt collectors where this 240,000 pound debt come from in Wales,they said no proceedings have been started in Spain as yet,not even court proceedings,and yet all them years ago they had an official letter off us stating that the property was not finished(unlivable) it had been signed off by a notary. And we thought that was it,beens we heard no more from them.Very naughty and cunning,has far as we are concerned. So hopefully I hope we can avoid the BR route,but at the same time,we have,nt got 250 pounds let alone 240.000 pounds.

Posted - 14 June 2012 : 21:54:02 I think he is on the mortgage,as well as the deeds,but nothing as ever come in his name for either properties.Ow can a Spanish bank you have not heard from in six years suddenly appear with a 240000 bill,we only loaned 100.000 pounds.cannot believe this has happened to us,especially just has we were getting straight. We hVe interest only mortgage on the house we live in here,are they likely to take this off us,We are probably in slight negative equity.

Is your son on the mortgage or just the deeds?
