Posted - 26 June 2012 : 18:25:25 Hi Callaway, Just to add for your own peace of mind, and research. You can download the statement of affairs that you would have to fill in if you decide to go bankrupt. That way you can look through the exact questions that will be asked.

Posted - 26 June 2012 : 15:59:27 Hi there all. The Official receiver will consider transactions at undervalue up to 5 years before the date of the bankruptcy. As such a transaction at under value carried out more than 5 years ago will not normally be of interest to the OR. They will consider preferential payments up to two years before the date of the bankruptcy.

Posted - 23 June 2012 : 12:57:37 I think its 2 years for some items. I gave a car away in good faith within 2 years of declaring BR, and the OR wanted to recover the value of it from the person I gave it to.

Posted - 23 June 2012 : 12:38:34 I also think they do a 5 year check on you to see if you have bought anything or high value or sold it for say £1 just to get rid of it. |

Posted - 23 June 2012 : 12:32:52 Without knowing the value, and when they were bought its slightly tricky to answer.
It is also an offence to obtain goods when knowingly you can't pay for them.
An extreme example would be to take out a loan just prior to declaring bankruptcy.

Not sure.. I don't think so. Normal household items are of no interest to the OR as far as I know unless they are of stupidly high value. If they were obtained on credit then I am not sure but I don't see why they should
The home shopping company cannot take any action against you. They may write to you until the official receiver notifies them but all you have to say is that you are bankrupt and they will be informed in due course. That said you are under no obligation to communicate with them. As soon as your made bankrupt you do not have to have any contact with them ever again unless you wish to in the future.
Im sure someone else will come along soon and clarify
It is an offence for any creditor to contact you once they have been notified you are bankrupt. |
