bailifs and council tax? my husband and myself have been in bankrupcy since april this year. last month we recieved a letter from the council stating that we still owe money from july 2006 this letter with letters confirming our bankrupcy was sent to the or and the council, today we recieved a nasty letter from bailiffs wanting to enter the propery and collect goods. where do we stand regarding the legal issues of the bailffs and as we are in bankrupcy can they ask for this money? |

What difference does the date make?
They can either take legal advice or refuse them entry unless they have a court warrant.
Ascend may you find no resistance
Know that you made such a difference
All you leave behind will live to the end
The cycle of suffering goes on

Agree with Debtinfo.
What you need to do if they've not already been there is to make sure that all doors and windows are locked as they can enter if they can find somewhere open.

If they have a liability order then yes they can although it is slightly more complicated than that, they would have to surrendey the proceeds to the OR but they they would then rank ahead of other creditors but behing preferential creditors, It may not be worth them doing it but the bare fact is that they are allowed to continue to seek to take goods. But they still have to gain entrance peacefully if they have not taken a walking possession already,so if they have not been in before, dont let them in. The obly people that can really call them off is the council so i would start there by telling them you obviously have no way of reapying ie bankrupt and asking them to withdraw the bailiffs |
