Hello, In brief, I wanted to say something to everyone who is just setting out on the journey through Bankruptcy.
In 2007 I entered into an IVA through Grant Thornton and at that time I thought my problems were over, that was until I lost my job in late 2008 and could not meet the IVA payments. Grant Thornton were very patient but after almost 2 years of waiting they had to cancel the IVA and the letters and phone calls started again. With no income and debts of over £50k, Bankruptcy seemed the only remaining option.
I read countless debt advice websites and eventually, with no prospect of employment on the horizon, the decision was made to proceed. The process looked long and complicated but with the help of the people on this Forum and my local CAB Debt Advisor, I went to court and was declared bankrupt on 21st December 2011. Today I have received my discharge from bankruptcy and my whole life now lies before me without the worry of missed repayments or letting phonecalls go to voicemail because I knew who was on the other end.
I actually feel a little guilty that I have been able to walk away from my obligations. This is not how I was brought up. But circumstances dictated that there was no other option.
To everyone who is looking at the court paperwork and wondering what the hell it all means, I would offer one work of advice.
ASK.
The people on this forum are knowledgeable and will help you.
Your local CAB will (should) have a debt advisor who can not only advise you, but can also help you fill in the forms. This service will not cost you a penny. My own circumstances could not have been more straight forward in that my partner (unconnected to my debts) works and I had no income or assets. Your circumstances may be more complicated but believe me, people will help you.
Also, please do not fear going to court. My own experience, although humbling because of what you are having to do, was painless and I was never talked down to or made to feel that I had done anything wrong.

That's terrible! I always tell everyone that speaks to me that they can do it themselves and I email them a step by step guide too. If they want to come back to me they can do.

There are some good companies out there which can help you go BR if you are struggling and our experts on here will give free advice in the first place anyway. |

I completely agree with homerjay, BR is not a pleasant experience but my local CAB helped me enormously through the process and didnt make me feel that i did anything wrong, as did the clerks at the county court....all very polite and helpful, not as daunting an experience as i imagined..
One thing i would say is to not be pressured by the firms that charge you £££ to oversee you through BR, one of them told me that i should use them (for a fee of £400) because if i completed the forms myself and didnt complete them correctly i would lose the £700 court fee and would have to pay again!!..........which is, of course, totally untrue. |
