Posted - 14 September 2012 : 12:33:37 Well I've contacted my local court to check the procedure (make appointment, 5 day lead time) downloaded the forms, and now planning to sell my car to pay off a log book loan and buy a £1000ish replacement. Then it's just a case of 2 more paydays to raise the fees. Just have a few final questions before I sign my life away:
1) the court staff that replied to me reiterated the necessity to have sought advice....something I am well aware of- just wondering if the judge asks for evidence of the advice sought? Or is it just a case of saying 'yes I have your honour'? I have had a phone chat with Viki from VB and have an email from her stating we have agrees bankruptcy is the best course of action. Does this count it does it have to be CAB or such?
2) I see on the SOA it asks for a tenancy agreement, I don't have one as I rent off my dad....my bank statements do however clearly show the rent I pay him every month as a standing order.
3) checked my 2 main credit files- experian is not showing my 2 CCJs but equifax is.....is this unusual? I thought so given experian is meant to be the main one! Also awaiting file from call credit, who don't seem as efficient as the other 2 at providing immediate online access....got to wait for a pin number in the post!
4) also on credit files, there doesn't seem to be as much as I'd thought on them- so there's things I may end up missing on my SOA...but am I right in thinking that doesn't matter as any debt incurred prior to BR is covered, whether listed or not? Also the credit reports don't have agreement numbers etc. on them (mostly just crossed out showing last 4 digits). will OR just dig for these?

Posted - 14 September 2012 : 12:50:07 1. You sought advice from me, we chatted through your options and you understand bankruptcy, so that's enough.
2. That's fine.
3. Sometimes all 3 credit files will be a bit different, I know mine were.
4. You will need the account number for your statement of affairs, so you will need to contact your creditors. And yes, any provable debts prior to bankruptcy will be included even if missed off the forms.
