Help please....
Back in 2011I did a deal with a builder whereby he told my mortgage company I paid him a deposit payment in order for the mortgage company to lend me the money to complete the purchase of my house. This was not true and we actually agreed that I would pay him back the amount over the term of the mortgage. The amount was 50k plus he agreed to loan me another 10k which would allow me to clear existing credit card debts and therefore start repaying the amount. He never paid me the additional 10k so I have not paid him anything back, despite me offering to pay reduced monthly payments I.e. 150 a month in stead of 300.
He is now threatening me with a statutory demand. My argument is that he has not for filled his agreement.
Can anyone tell me if I have a case to get the statutory demand set aside?
