Posted - 24 April 2013 : 21:16:45 Hi all, i went bankrupt 2 weeks ago and have still not had any contact from the OR. I did a stupid mistake today as i currently rent a house that is to be included in my bankruptcy and although the tenant has now moved out i arranged to transfer the final BACS payment to go into my partners account this month so i could pay the tenant her deposit back. Only the payment actually went into my own account. I transferred the money into my partners account manually today and now i feel i am in big trouble with the OR when they do contact me and find out. Can you give me any advice? |

Bankrupt 2013, welcome to the exclusive club, so exclusive you can only join with special permission from a judge !
yes potentially the OR can shout or should ask questions. As a landlord you have / had specific responsibilities for the tennant and keeping the tenants deposit safe.
obviously by the money entering your account the OR may ask to look at your partners bank account and the onwards transmission of the money to your tenant.
i would have ready in case the OR wants to fully review the transactions 1) copy of tenancy agreement 2) any correspondence relevant to the money being paid into your account as a deposit at the start of the tenancy 3) the steps the deposit has recently taken. your account, partners account and then onward payment to tenant 4) receipt from tenant for deposit.
