Dec Bankrupt
Posted - 30 August 2013 : 14:12:22 Hi
Made it thorugh my bankruptcy in Dec 2008, discharged in Nov 2009, and managed to keep my house. My Ex (we divorced in 2012) left prior to my bankruptcy and has made no attempt to pay any money towards anything, his daughter included. I have kept the Mortgage upto date and with my new patner and son, we are looking to get married in 2014.
What options have I got with regards to stopping my Ex affecting my family's future with his non payment?
The following has been mentioned: My partner has talked about taking on the mortgage and my ex's unsecured debt. Changing the BI with Land Registry has been mentions but no solicitor that I have contacted has got back to me.
I have found it hard to find someone who can advise on all aspects of my situation, but would be greatful for a clear idea of what all my options are.
Hopefully someone can advise...

As to the house, it would need your ex's consent to come off the mortgage & deeds - as things stand now they would have a 50% interest in any profit regardless of whether they have paid anything since they left as it is seen as you paying because you have had the benefit of living there.

You could try to have your ex taken off the mortgage by the lender and I see no reason why your new partner cannot take over the other half of the debt if he is willing to do so.
Speak to your mortgage lender to see if this is feasible.
