Posted - 24 November 2016 : 18:49:42 Hi just wondering if you can give me some advice ,my wife regularly posts on the bankruptcy forum and we recently reached the 6 years after bankruptcy and it has been removed from our credit reports.What has happened is we recently applied for marriage allowance and my wife transferred some of her personal allowance to me ..anyway to cut a long story short we rang hmrc to claim a refund for tax for 2015/16 and were told we were due £212 but according to hmrc there is a block on my account and they cant process the refund due to the bankruptcy.
I was wondering if you know anything about this and if we would be entitled to the refund as we declared ourselves bankrupt in 2010 and were discharged in 2011 ? HMRC are looking into it but im scared we could open up a can of worms !!
Any advice would be really appreciated Thanks for your help

Posted - 25 November 2016 : 15:11:46 As far as I know if it relates to a period after your discharge this should be yours to keep.
Sounds like a nightmare! Personally I don't think they can do that as you are discharged and, even if you had an IPO, that would have finished.
As the rebate relates to well after these dates I would have thought that you you could keep them. Hopefully Lisa Thomas will be on later to confirm and give you advice on what to do - HMRC are a law unto themselves!!!
