my iva was excepted in feb one of my creditor
that didnt even bother to vote are now threatning court action how does this work as they were included in my proposal

Hi Sharon,

If your IVA was accepted, this creditor is now legally bound by it and has no recourse in law unless the IVA fails (usually after 3 missed payments).

Good morning and welcome to you,

I was always under the impression that as long as there was a majority agreeing to the IVA then they all had to oblige, so that means that they have to stick to the terms of the IVA.

I would find out from your IVA company what they intend to do as tech they should not be writing to you now, its dealt with by your IP thats what you pay them for.

And no i do believe that they should not be able to take any further action, thats providing your IP are doing there job.
