Posted - 30 August 2008 : 15:13:00 I was talking to an eastate agent and she informed me that it best in our interest that we declare BR and then look for rented accomodation as the OR (since they are getting stricter apparantely) will take a dim view of how we came up with deposits (some agents are asking for 6 momths or a garantor) and then its not defiunite as to whether we can rent or not. Also she said why we are looking for a three bedroom as its only is myself and my wife and our onbe daughter and she said OR might not see this favourably. I am now completely worried and my head is spinning about all this and your hellp is greatly appreciated as I honestly think I am loosing the plot. Is going to an expert firm better as I dont think I can handle this. Its all too confusing.
Also I have written the reason for my BR can I post it here for some coments, I have been honest but not sure if is good enough, they also ask when I started having difficulty paying my creditors , is this from the time we decided to go BR as prior to that we were living off my overdraft and also loans.

Posted - 31 August 2008 : 12:51:45 Hi rv02, we went BR on the 21st of july but had secured a rented property just before that and actually moved in on the 26th of july, the main reason for this was so that our BR address was on our old property not the new landlords, as he wouldnt have allowed us to move in otherwise! Our OR was fine about the fact that we hadnt paid our mortgage for 2 months prior to bankruptcy as we needed £1,000 for the BR fees and £1,000 for the deposit and 1 months rent in advance so i shouldn't worry too much about it. The estate agents will take admin fees which can be quite alot and then you still arnt guaranteed to get the house, so you will have lost that money as it is non - refundable! MY advice is try and find a private landlord and get the property before you go BR but try not to actually move untill after the BR.

You know where we are if you have any more questions. LOL Its a lot to take in and sometimes in a short space of time and everybodies head goes into a whirl. But you have to do whats right for you. one of the many, and most common, reasons that people in difficulty financially find it almost impossible to make a considered decision on what is their best solution is that too many opinions, whilst they may be given in all honesty, can confuse the issue.
I would ask you one question RV02, if you wanted advice about which car is best for you, would you go to an estate agent? Of course you wouldn't and I would suggest an estate agent, all respect to any that use the site, are as equally knowledgeable about bankruptcy.
It is natural to want to speak to as many people as possible when we're in a mess but you need to make a decision on where you want to go to find the information you need. Once you have made the decision try hard to stick to it.
This forum will give you all the support, advice, shared BR experiences and technical advice you need. Please don't be tempted to listen to an estate agent. I don't like to criticise anyone that tries to be helpful but they can only try if you approach them and ask. Doing that too often will leave you more confused than when you started. On reading the many postings on the forum you will also see that CAB, CCCS and the National Debt Line have given forum members wrong advice, not very useful advice and in some cases no advice at all. Yet many are delighted with the help they receive from these organisations.
I really do understand how difficult this all can be and some people find it is too much to cope with on their own.
If you really are overwhelmed by all this then perhaps in your case professional help is what you need to enable you to feel you have the right support and advice. If you wish I could happily recommend someone to you who will provide whatever level of good professional assistance you require.

It's always adviseable to get the rental sorted prior to going BR. Most letting agents will perform a credit check, and if you've just gone BR, most will insist on up to six months in advance rather than the usual security deposit of 6 weeks.
The OR may not like it, but will appreciate that a roof over your head is the No 1 priority!

You are in a state. Well your in the right place of course. We are all here no matter what to help you.
Everyone does the move into rented differntly, some have done prior some have done after, as for myself i have gone BR and will wait to look for rented as we dont have anything secured against our home and can just about afford the interest only payments at the moment. As for the OR taking a dim view on when you move i cant see how that is relevent really. It does not matter. CG i think it is has moved recently and is waiting to go BR, she may be able to offer more on that side of things as i have not actually gone looking to rent yet, i was going to look from discharge next year and muddle through as we have equity and the OR will want that but i have to wait and see what happens really. The size of the house i would have thought again would be irrelevent as long as you pay and are not within your means. Your reasons for BR so far sound very similar to the many on here, we all have our reasons and its nothing to be ashamed about, whats done is done. Anyhow hang on in there and someone else may be able to offer more advice. JO
