If your council tax "arrears" have been re-scheduled into monthly payments, then it will be viewed by the OR as exactly what your council tax should usually be. The great news is that this will depress your DI when calculating out an IPA.

Posted - 03 September 2008 : 15:21:17 This will at least give you monthly instalments, but will not mean that any of the debt is included in the BR, meaning that you will pay the whole bill. Its catch 22!!!! |

Posted - 03 September 2008 : 15:02:15 Just wanted to tell Charlie and Steph, that I experienced problems with my council tax being included in my bankruptcy. I went bankrupt on the 2nd Nov 07, and put down my council tax as a creditor - but i didnt know the amount as they had taken 2 months to send me a bill. They sent me a bill 3 weeks later, and i battled for 8 months to get it included in my bankruptcy - but in the end they won and it started off at £500 and shot up to £700 because i hadnt paid it - because I was told by my financial advisor and OR (of all people) it was illegal to pay it!!!
Fair to say i was gutted at having to stump up £700 after receiving a Court Summons!
So....my tip is get the bill issued to you before you go bankrupt. |

Posted - 03 September 2008 : 11:07:25 No probs Julian To be honest i was of your mind until this came up. from the comments from Ian, it appears that this particular Council had a hidden agenda and searched hi and low for a loophole around collecting monies. I will say that 99.9% of councils will play ball and automatically write off. |

Posted - 02 September 2008 : 20:10:49 Sorry to disagree Julian whilst 99% of Council tax debts are included within BR proceedings if you have had a bailiff to the property and signed possession has been granted on goods then these goods are the bailiff's possession.

All unsecured debts (apart from student loans) are written off in BR, including rent and council tax arrears.
