Posted - 05 September 2008 : 16:58:17 I am just concerned that the judge wont accept my bankruptcy, are there any certain criteria that he will go by to accept me?? I am on maternity leave but only receiving the basic Maternity allowance of £468.00 and child benefit of £72.00, my partners income is £1400.00, as a household we are bringing in £1940.00, but by the time my debts and basic house bills are paid out we are £-48.00, this is not including money for clothing, entertainment etc. My maternity stops in feb and we will only be bringing in £1472.00 so we will £-420.00. Will the judge take this into consideration?? I would appreciate any advice. Many thanks Emma Malton |

Posted - 05 September 2008 : 17:56:55 Hi Emma and welcome As long as your insolvent as in you dont have enough money to pay your essential living costs and your debts, then you should be ok. From the sounds of things you may not get an IPA either, thats making an additonal payment from any left over money after paying your essentials per month to the OR. Hope this helps.
