Having spent most of the day trawling the internet to find info to no avail i will see if any one here can help .
On looking through a copy of a recent refinancing loan application ( to pay off existing loan + £5000 extra ) , i have noticed it states the balance of all credit cards as nil . I am positive i wasnt asked this over the phone , but as im sure other people do , my wife and i signed the loan papers when they arrived without checking the smaller details . Can this be classed as a criminal act / fraud / deception by the OR and result in prosecution . I have not booked a BR appt yet but have had the forms sent to me . Would really appreciate some expert advice on this matter .... Thanks

original loan of £22000 was took out feb 2005 , but that was refinanced in march this year after paying 25 payments of 84 . have paid 5 payments of £332 on this new loan

probably not thinking about it but you hear of it so often these days (calls being recorded "for training purposes") that it may well be the lenders policy.

Even so, on the scale of things the borrowing itself, rather than the details of the application, may be a bigger issue.

When did you take the loan out?

Hi digman

I shouldn't worry.
If the OR queries it tell him you were not asked the questions at the time of application and you didn't read the small print when the papers arrived for your signature.

As you say most people would do the same.
If the OR does question you on it I doubt it would lead to anything. Invite him to request the taped telephone discussion from the lender.
You can't get away from the small print entry but who reads that when we're in desperate need of the money.

I cant help you with this as im not sure how this would effect your BR. Maybe one of the other experts can advise you on this.
