Hi all.

I post regulary on the IVA forums i find everyone there very freindly and helpful.

To cut a long story short about me-I have been made redundant twice in the past 12 months. I am behind with all my creditors by several months although I have treid a DMP and had an IVA proposed but i was made redundant a week before our creditors meeting. Between me and my partner we owe approx 45k, we rent, have no assets apart from a car which has 3 months left to pay on it and is probably worth £1500
I drive HGV for a living and my partner works in a solicitors.

I dont know if it would be in our best interest to go bankrupt but wondered if you could answer some questions for me?

1. what papers does it go in?
2.how to i petition for bankruptcy
3.Doesour landlord find out?
4.would i keep my car
5. what happens after the hearing?

yes im in an AST and have copies of the agreement. I am not renting through an agency, but directly through a private landlord. If he was to find out then we would be out, no doubt about it so it concerns me that it is not definate that he would not be contacted.

copule of reasons.

1, if the rent you are claiming is substantial they may want to ensure that you are not lying about the figure you are claiming.

2. In the event that the rent is not through an Assured Shorthold Tennancy ( AST ) then there may be some benefit for the OR. I am confident that you will be in an AST so by sending a copy of this to the OR QUICKLY will probably mean they don't contact the Landlord.

Hi and welcome to the forum.

it is difficult to answer the above fully without knowing all the facts such as disposable income etc, but the answers to the above are as follows:-

1. Papers :- Local paper, London gazette, Stubbs Gazette and of course it is registered on the Insolvency Website

2. You need to complete a statement of affairs and a br petition which can be downloaded from the insolvency website, completed online or collected from your local court.

3. Landlord. The landlord may be contacted but if you provide the OR with a copy of the tennancy IMMEDIATELY after the Br then it is less likely that they will be contacted.

4. If you need a car for work it would probably be excluded

5. depending upon the court you may have a telephone call with the OR straight away or within 2 days. You would then have a scheduled longer interview within 2 weeks.
