no criminal proceedings have been taken against me from dwp, i have my appt to put my petition in on tues, so do you think i should still go ahead? had some advice from cab if they havnt dealt with it as fraud so far, 18mths later now, then i can go br is this correct.

Hi jacqui

I know from our chat that the debt is really bothering you but my view is if the dwp are not instigating criminal proceedings then the alleged overpayment will not be reclaimed by them.

Unless you have other debts you cannot pay it may be you are about to declare BR for no reason and sorry to be blunt, but that doesn't make any sense.
In fact, if that is your only "debt" then the court won't allow you to declare BR as, at the moment, you owe nothing.

Please think about this carefully.
