Thank you for your previous replies.

I am just wondering, are all debts can be included in Bankruptcy or are there certain debts u cant include?

Also, I have read my unsecured loan agreement and if am not mistaken it says there that in the event of bankruptcy I need to pay them in full? Is it right that?

Unsecured lending is written off in BR, therefore the clause is unenforceable.

Hi DnD

Our car one was like that, but it has been added to our SoA and so will be written off.
They stick these clauses in hoping people dont actually go BR and i they do then they try and frighten you.

Thanks John,

I am just wondering cause the working in my unsecured loan agreement says that I need to pay the full amount back incase of bankruptcy.

I just need to make sure that I will not go for breach of contract and that the debt will be written off.

Hi
you cannot write off secured loans, CSA payments, Court fines or student loans.

If the agreement you refer to is for an unsecured loan then it will be written off regardless of the wording.
