Hi people. I have not been able to post on here recently due to a broken computer and then being ill with my heart (ongoing chronic condition). I have had to put back my BR because of this. However this has now meant that the court date for repossesion is set for the 6 October. If i can't go BR before this date how long do i have to quit my home? ie. do i get 28 days notice for eviction? or do the bailiffs fetch up shortly after the court session to take the house? I would like to have time to get all my things out of the house if possible.
Help!!

Thank you Suzanne, that is most helpful. I have booked a BR date for 21/10/08 so i will hopefully be able to get things sorted by then.

The court usually give a 28day order unless asked otherwise, which means that the petitioner has to allow you 28 days in order to resolve the arrears. After this they then have to go back to court to request eviction, and the bailiff gives them a date he is available for this.
You probably have 6-8 weeks after the possession order is granted to make alternative arrangements, sometimes longer if they are not very quick or don't bother rushing for eviction.

Thanks Suzanne. Unfortunately I shall never get better but thats another story.
Anyway, if i do not attend the court for the repossesion will they just summarily issue an order for possession followed by an application for eviction? Any idea how long this would take following an order for possession? I'm trying to work out how much time I might have to sort things out for my BR.

Hi
Hope you are feeling better.
Once they have an order for possession they have to go back to court to get an order for eviction, which can take a month or so. They may not be in too much of a hurry so it may be a while before they start to enforce the order. Either way you should get plenty of notice.
