Hi All,

I have now missed 2 payments on all my loans and C/Cards, my hubbie is out of work and I can only see us having BR money by Christmas as I will be able to pay out of my bonus - so intend to go BR early Jan. Do you think that is too long? I am getting worried about what can happen in the meantime, I am getting calls and have told ceditors I have spoken to CCCS and am considering BR and now I am not answering calls as the story has not changed.I am coping with calls I just hang up. Has anybody on here been 5 months not paying debt before going BR. What is the worst that can hapen to me?

Thanks I am reading everyday and it is a huge help.

Trish xx

Hi Trish

As Jenny says you could try writing to them with an offer and see if that works, that way you can buy some time so to speak.

Hope all goes well.

Take care

Hi Trish

Sorry for late reply. I did what others have suggested, i wrote telling them my situation and offering the pay them £5 each per month. All but one agreed (and this is the company i only owe £240 to)!! they said they would not accept anything under £10, however i stuck to my guns and paid them each month the same amount. I am not going to make any payments this month, as im going BR on monday.

Hi Trish

I dont know if this is any consolation but we changed our numbers to stop the calls before BR and that obviously helped to ease the stress of the debts and made the pathway to our BR a little easier.

Hi Trish

firstly I would never recommend that you rush bankruptcy. You need to be sure it is the right thing and perhaps the situation may change between now and january.

no need to worry about a CCJ - i sincerely doubt that you would approach a ccj before january and creditors would need one of these before moving to bailiffs.

the biggest stress comes from phone calls and letters. so i would recommend you get a plan and stick to it e the calls / letters. either answer them , advise of br in jan etc or either change your number or disconect the phone.

You have a lot to get ready for Br ( forms, bank accounts etc etc ) so start planning like a military operation

Hi Trish

Yes Co-op were the worst for me, which was abit surprising - I thought HSBC would be all over me!

That's it Trish - be totally honest, unless you have something to hide of course. Work out what you can afford to pay, and pay them this. Or make £1 token payments which should help a bit to keep them at bay.

Have you contacted any Debt Management Companies about a DMP or anything? Like I said previously, I have just entered into a DMP and am just paying what I can afford each month and just received letters from my creditors saying they have accepted it for the next 6 months / 1 year, which gives me some breathing space until I go BR (they don't know this) - maybe this would be good for you?

Good luck to you too!

Hi Dazed,

Thanks for your advice I was honest with Capital One on sunday and I cannot believe 2 days have passed without a call - they are the worst! I am worried about a CCJ as I am thinking Debt Collectors/Baliff can come in if I get one? I am thinking I may need to make token payments.

Good luck with your journey and thanks xx

Hi Trish!

I would suggest you pay token payments to your Creditors - I paid mine £1 each for 3 months and they were not too bad - I had quite a few phone calls and a couple of letters and some Default Notices but no-one knocking on my door or anything like that.

I am now in a DMP and like you due to go BR in a couple of months - maybe a DMP might be good for you to pay them what you can afford until you have the money for BR?

If you can't pay then you can't pay! The worst they can do is make you BR (which would save you the fee) or give you a CCJ (not too sure how these work to be honest) but if you can show that you are paying them what you can afford then I don't think there's much more they can do!

Try speaking to them - I avoided calls for ages and have just now started speaking to them and they are not that bad at all - just be honest!

Hope it all works out for you and take care!

Thanks Jenny maybe I will have to do that to keep hhem at bay but they ask for so much should I just pay £1?

Hi Trish

I have not been able to pay my creditors their full monies each month for about 4 months now, however, as i did not know i was going br until a couple of weeks ago, i was considering my options so paid a 'token payment' each month.

Dont know if this helps but thought i would let you know what i did

Take care

Jenny
