Posted - 10 October 2008 : 21:45:22 my husband has a debt with his business partner this debt was put as a legal charge on my own property have now gone br will the or see this as me having an intrest in my husbands business even though i have nothing to do with his business and i have not put any money into it and not on the mortgage thank you |

Posted - 11 October 2008 : 10:24:32 Hi you clearly have no interest in the busines but I think there are other issues here.
Is there equity in the property? If your husband's share of the equity has been eaten up by the charge related to his business it could be argued that all of the remainder of the equity belongs to you.
Having declared bankruptcy the trustee would claim all of the equity for the benefit of the creditors.
On the other hand, if the amount of the charge has tipped you into negative equity it has actually protected it until you decide to sell, however long in the future that may be.

So you are now debt free so to speak and had your interview. If the OR knows and has not worried you with other things about it then i would just sit back and wait to see what happens hopefully nothing and you will sail through and if they do need more info then they will ask you about it. But in all honesty i would not worry about it, you would have mentioned i expect at the time and so i would just enjoy being debt free. Good luck mate whenever you need us we will be here:-)

Posted - 11 October 2008 : 07:37:34 thankyou i would just like to add that no actual money was given to my husband it was a gentlemans agreement but he wanted some security on it and my husband didn't have any and its been my husband who pays this but didn't realise that when we lost the house i became liable (must start readind small print!!!) My experience so far has been really good everyone involved seems "human" and i have not been judged for what has happened i have my OR interview on wednesday and having spoke to him he sounds ok everything else is straightforward i hope but this is the best thing i have done have struggled for 4 years and wasn't getting anywhere now i have a life again
thank god i found this website as it has calmed me down and been very useful

I dont think the OR will see it like that but im not 100% sure.
