Posted - 15 October 2008 : 20:28:46 Hi There,
We have recently declared ourselves bankrupt and it has all gone very smoothly so far. We just have a question that no one seems to be able to answer even the OR... Are ground rent arrears included in the bankruptcy or not? We are being pestered by a land management company who are demanding full immediate payemtn of ground rent we were unaware of....
Any suggestions would be helpful as this one seems to be a mystery to everyone!

I dont know if this helps but its actually a difficult one to answer. The general consensus is that ground rent arrears can effect the title to the property, so can be assumed to be treated as secured debt.
Only a guide though as insolvency law is a bit complex. I dont know if this helps at all.
If you want to discuss this in more detail or feel you need to clarify anything then give us a call, its 0800 078 9367.
Take Care
