Hi, I am currently in an IVA which has just failed following on from my 2nd annual review, this is due to the fact that my cost of living has increased but my salary hasn't. The IVA company have requested I declare myself bankrupt and they are holding a meeting with my creditors in November to explain my current change in circumstances - which are.
I met my husband over a year ago, he is an Albanian National, I found out the he didn't have a visa to be in this country and we planned he would go home, I would go to Albania to get married to him for him to apply for a visa to come to the UK legally. His visa was refused. I now cannot afford to live in this country on my own and he currently isn't working in Albania due to lack of jobs over there, so cannot help with financial support. I will be homeless in the next two weeks, due to my landlord serving notice and selling his house, I have a couple of friends who have agreed to put me up for a couple of weeks. Any household items in this property belong to my mum and will be going with her once I move out, they consist of fridge freezer, washing machine, she is looking after her elderly father and will continue to live with him. I need to be with my husband now and wish to start a family with him, we have been apart since May now and I have only seen him for 2 weeks in June when I went over there to get married. Being apart is depressing me and I no longer want to live in this country without him. I am able to move to Albania and we will be supported by his family until he is able to get a job.
Is this going to be possible? |

Hi
firstly if your IVA has failed you are not obliged to declare yourself bankrupt. If the creditors want you bankrupt it is for them to petition for your bankruptcy via the IP.
To declare yourself bankrupt you will need £345 to £495 to do so. If the creditor's want to petition for your bankruptcy it will cost you nothing but it will cost them approx £2000.
There is no reason you should not move to Albania if you so wish. However, if you do and the creditors petion for your bankruptcy in your absence you will have to deal with it should you return to the UK in the future.
