Posted - 22 October 2008 : 13:11:42 Hi all
Its been a while since I last posted on here, but once again advice please if you can. To re-cap, I should have been paid out £25K from my ex for my part of the house. We split up nearly six years ago. I have approx £40K equity and she has borrowed the £25K from a family member and so has not had to sell the house. This money is sat with her solicitor awaiting transfer to mine. She can not raise the rest of the money she owes me and so is signing legal documents stating she will not make any claim on my pensions which do not mature for about 15 years anyway. I am happy with this arrangement. I have not paid anything into this house for three years now either.
I have had a large amount of debt for many years now which I was paying off at £300 a month and had paid off £8K until ill health forced me to change jobs. I have been unable to pay my creditors since and have more debt now just trying to survive as my self employed work does not make much. My partner has gone into debt due to me, my family have helped me out as have a few friends. Since a car crash recently I can no longer do manual work and am under physio. I am expecting this £25K imminently but my solicitor will be taking £6k of it before I see anything. I know I am not allowed to favour any creditors but I will be seeing my partner ok with £10K cash she has leant me as I will not see her go down the tubes because of me. I am going to use £4K to pay off a van loan which is in her name and is my works vehicle which I can not do without. I owe other family members £3K which was given to me on the knowledge they knew I would be getting a small settlement from my ex. This would now leave me 2K. I owe £55K, some of it going back up to ten years ago until it was frozen. I no longer use any of the credit cards and can demonstrate the only usage on some of them is the interest I pay each month. I am probably going to go bankrupt sometime next year. All I want to know is what is the worse the courts system can do to me. Please do not say dont pay your partner her money back as I'm afraid that is not an option. Anybody I owe and pay out will be in cash so will not be traced. Thank you. |

Posted - 22 October 2008 : 13:58:57 Hey ACM,
What a long post. I know you have probably heard this all before but i do seriously think that a call to us may help, you have other assets that need protecting and you need to know what your options are right now.
So with that in mind our number is at the bottom here but please call us, we will get back to you and then we can see where we can go from there.
Best of luck
Jo
