Posted - 25 October 2008 : 22:34:11 Hi, I have just received a default notice from capital one. we were made BR on the 9th Oct. On this default notice it states they will not take me to court to get a judgement against me whilst the bankruptcy order is still in place. I thought that going BR meant the end to any debts. I am so upset! what did i go through the bankruptcy for, if these people are still going to come after me. Please help

Honestly, mate in a week or so it will become oh so clear!
Just dont worry about me using the other name as i wont be, its not me being a complete lunatic i was advised to do so, it really is a case of watch this space and you will see.
This is the fun part, no one knows, not even me!

You will still get the letters coming in and for a few more weeks yet im affraid.
They do eventually get the message. My creditors stopped sending after about 6 weeks so now i dont get anything :-)

I agree with John and the others.
I would contact your OR on Monday let them know verbally then post on any and i mean any and all letters like that to them. We are paying them to do a job and that job is to deal with our creditors now and not us.
There is nothing Capital One or any of the other creditors can do now, so sit back and relax.

you have nothing to concern yourself with here. Capital One internal procedures, and they are not alone, are clearly sadly lacking.You do still owe all of your creditors but they are legally bound to deal directly with the OR's office.
As per the other member's advice, inform the OR and leave him to deal with it. Your bankruptcy has acheived the most important thing, you will be debt free. Neither Capital One nor any other unsecured creditor can make any claim from you except from your estate which is now vested in the OR.
Incidentally, technically your debts are not written off until you are discharged.

I would send this straight to your or, and if you feel you need to phone them first thing on monday. Maybe there was an overlap in dates and maybe the or hasnt got round to informing them yet. As far as im aware you are protected by your br. I have received numerous letters from creditors this morning and have posted them off to or. I personally would phone capital one, but do whatever you feel will make you at ease
