I was in an IVA from May 2007 until May 2008 when it failed because my circumstances changed. On the 15th August I went bankrupt and I had my interview on the 17th September and an IPA agreed. One of my creditors MBNA who changed to Max Recovery during my IVA has now passed its details onto Eversheds since my IVA failed. I had a call yesterday from a VERY rude lady who claimed I needed to pay Eversheds the oustanding money. I told her I was bankrupt and that I no longer lived at my previous address but couldn't give her my new address because it had been withheld by the court for various reasons.

She said very aggressively you HAVE to notify us by law of any address change blah blah blah. I stated again that I couldn't tell her, I gave her my bankruptcy number, my full name and which court and which date I went bankrupt.

She then started getting very heavy so I put the phone down on her. I did ask her to stop talking to me in that manner but she carried on.

I called my OR who said I done exactly the right thing that I didn't give her the new address, he said that Eversheds have obviously taken over the debt from Max Recovery just before bankrupty. He said that on the 30th September he sent to Max Recovery my bankruptcy report etc. He said Eversheds shouldn't be contacting me and that its up to them to contact Max Recovery to get that report as they obviously never passed it on. He said anymore problems give them his details and that I am now protected by the courts. If they wanted to take any further action it would be a total waste of their time and money.

Today I received another call from them from a man who was also VERY rude and said I need to get the OR to send them the report. I explained what the OR said and that they are to contact Max Recovery, he kept talking over me and not letting me finish. I got so upset I put the phone down again.

I thought all this would go away. Is there a chance they would find out my new address? On the newspaper advert and insolvency register it says that its withheld but I am now very worried. Also my aunt lives at my previous address, will they turn up there?

Please help!

I can agree with what Paul said. I've been getting calls and letters from Next. When i spoke to them last i did tell them that i had already given them my OR's details and that they should be contacting them. They said that they hadn't had anything from them and they usually do within 2 weeks of BR. They very nicely put my account on hold for another month though, got a letter yesterday with more charges on!!!! I called my OR office who informed that they had only written to my creditors on 21st October I went BR on 18th September, so definitely a few delays going on.

When we fend off these calls for clients I often ask the to quote the law that means that:

you have to pay , even after Br, etc etc et c.

they often struggle with this one.

Most important thing is NOT TO GIVE OUT YOUR PERSONAL DETAILS TO ANYONE ON THE PHONE. the banks recommend you don't so simply follow their advice.

Without your personal details being confirmed ( DOB , maiden name, what your pet had for breakfast and the colour of your undies etc etc etc ) then they are breaking the law if they discus the case with you.

simply ask them to put any request in writing and to remove your phone number from their system . Then forward the letters to the OR.

I have to say that the OR offices are " a little busy" at present so while they have to contact creditors in a specific time I suspect that it doesn't happen in every occasion.

We find it useful to write to all creditors the day after BR with a copy of the BR order and request that all further correspondance / calls etc be dircted to the OR at whichever office.

sometimes it doesn't happen but usually it works well.

Alternatively you can call the creditors - you will be put through to a completely different department who handle Br - where you will usually find the nicest most pleasant people you could emagine.

They thank you for updating them and wish you all the very best in your new start.

If only the banks used these people when chasing money. I suspect they would do rather better.

You could just call them and give them a fake landline number saying you have moved and want to update their records for your phone contact, they will update it and wont keep your previous one x

Hi Maizie

I hope that soon they will get the message and back off for you.

I do know how you feel, we go BR to stop all of this but it can take a while for the letters etc to get to the relevent depts and then by that time its caused so much stress that we wonder if it was worth it.

But it is worth it and i know that once those creditors finally get the letters from the OR then the calls and letters will stop and the postman will have a much lighter bag ;-)

quite often one finds that the collection teams are fully trained on collection techniques and how to control a conversation.

It would however be quite useful if they also had a small seminar on insolvency and what bankruptcy means.

so often people are told that they still owe the money and they have to make a payment.

Hi Miazie

if you've a mind to when they next call ask for their full name and contact number.

Then advise the caller that under the terms of Section 40 of The Administration of Justice Act 1970 it is a criminal offence to contact you regarding the debt having now been informed of your bankruptcy and that you will have no hesitation in calling the police if they call again.

If you google the act you will see the detail.

I know what you are all saying and thank you for your messages. I guess I am just having one of those days, came out in a coldsore this morning... always get them when Im stressed!

I know they can't touch me, I gave them all my details, my bankruptcy number now so if they call I will just answer it and cut it off straight away.

COuld you ask the mobile company you are with if they can change your number as you are getting a lot of crank calls for example?? No idea if they will or not but worth a try eh? Or you could get their umber blocked if you know it doesn't stop them from using another number to call you from though.
It will all go away eventually

I just called the electoral role... I am protected on that side of things as I opted out of anyone knowing basically!

But the creditor would still have my old mobile number and would try that again if they go no joy with the fake one surely?

I would just give them a fake mobile when either they call you or you call them.

I did exactly that and it saved all the calls.

My aunt is aware of my bankruptcy but she is registered disabled so I wouldn't want anyone coming to the house and giving her hassle etc.

I registered on the electoral role just before bankruptcy so I could get a bank account but can't remember whether I opted for the edited version or the full version. Apparantly the edited version can be given to anyone who pays for it! So I guess Im not even safe with that!

Im in a contract with my mobile and as yet haven't had it cancelled and I would like to keep it that way. If I change my number I don't know if anyone would give me another contract.

They don't have a home telephone number as I don't have a home phone.

How do I get the hassle to stop?
