Posted - 03 November 2008 : 15:15:23 Well rang the courts today and got a date to petition our BR, Tues 18th Nov.... Feel pressure now as need to get the forms done but at least it is a date to work to.
My wife & I are really worried about whether or not to tell our new landlord about our situation as I found this in the contract..
"11 Enforcement of Obligations 11.1 If at any time during the Tenancy: The Tenant fails to pay the rent or any part of the rent for more than 14 days after payment is due; The Tenant fails to observe or perform any Agreement or obligation under this Agreement; The Tenant becomes bankrupt or enters into a voluntary arrangement with his creditors;The Tenant leaves The Property vacant or unoccupied without The Landlord or The Agent consent; Then The Landlord will be entitled to take immediate steps to recover possession of The Property from The Tenant by issuing proceedings for possession in the appropriate Court or Tribunal. In the event of The Landlord taking this action this will not alter any other rights or obligations within this agreement unless the Court or Tribunal rules otherwise."
I know a couple of you said make an annonamous call but I don't want to trigger suspision if we do not let them know. Shoud we tell them or should we leave it? Just don't want to loose the house as we really like it and have only been there 3 weeks.... |

Posted - 04 November 2008 : 08:44:43 Just to let you all know, my wife decided to contact the agency last night to be as "upfront" as.
All was ok, they half expected that is what we may be doing and as all original check went throught they said as long as payments are kept up there is no problem. They also thanked us for being so honest about our situation... phew!! One worry off the list!!!

Posted - 03 November 2008 : 23:59:50 an anonymous call to the letting agency may help, at the very least give you some time to speak to them and put their mind at rest.
Over a few years i have met with many letting agents who initially were absolutely against having my clients as tennants. However after long conversations most of them see things my way now.
Much better to have someone without a debt problem -absolutely guaranteed because they are bankrupt, rather than someone with a potential problem down the line.
People in Br realise that they don't have a safety net and as such tend to really focus on what is important and ALWAYS pay their rent / mortgage.
I am suprised that the banks haven't cottoned on yet - what a great target group. NO other debt.

Good to see that you've booked you're date. Try not to worry, easier said than done I know all too well!!
I sent my OR a copy of my rental contract and they could see from my bank statements that i hadn't missed any payments. I was told that as I had sent all the details in and nothing seemed amiss they wouldn't contact the letting agents. The letting agents haven't been in contact with me and i went br on the 18th Sept so really not worrying about it now. It looks as though from the clause you've quoted that it's pretty standard and as long as you don't miss any payments you really shouldn't have anything to worry about. You could put the anon call in if you want it might ease your mind a bit. I wouldn't worry about raising suspicion as i'm sure they have quite a few tenants and wouldn't know which one had called. And don't worry about going in the paper, i never check those columns, no idea if mines been in or not, no-one has said anything to me although i have told my mates and work colleagues that i went br and they were all great about it as they understood that i had little option. Honestly, sometimes things seem far worse than they really are and you have to take a step back and look from the outside in to see what thing really are. Hope that makes sense and i don't sound patronising, sorry if i do, really don't mean to. Fingers crossed for you anyway hun Nat |

Paul - would you say it may be an idea for Turborat to contact the agents anonymously to see what they say about tenants and BR?

Might be worth speaking to the agency as they probably don't want to tell the landlord so soon after you have moved in

We are actually through an agency and have only been in 3 weeks. Just worried if we don't tell them but see it in the paper for instance?? Worried if we do tell them as we have only been in 3 weeks they may want us out... really confused!! |

how do you get on with the Landlord? is it a private landlord or through an agency?
The OR is usually interested in seeing if you have an interest ( as a long term sitting tennant), wether you are in an assured shorthold tennancy or an verbally agreed situation.
obviously some peolpe say their rent is 1,000 per month when it is 550, so thed like to check these things.
You may find it easier to send the OR a copy of your AST and confirm with bank statements etc that you are not in arrears. Perhaps even asking them not to contact the landlord.
Please remember that the landlord is really only interested in getting the rent on time every month. If they got grumbly with you then it swould take 2 months at a push to get you to leave - assuming you played ball. Everyone is better off with you staying!.
