I was declared BR in July and started paying an IPA in September. Only I have gone BR not my wife but if she wins on the lottery would the OR be interested or only if I win.
We have not won yet just hoping but you never know

Dave was great with me - he never complained and he was supportive through everything. He drove me to court and said that if my car had been taken he would get an old banger in his name for me to use. I couldn't have done it without him.

Onwards and upwards was my signature when I first went BR!

Same here - even when Dave and I moved in together I didn't tell him about my debts, and if I bought something I never mentioned it went on my credit cards. Dave was horrified when he found out exactly what I owed - I wouldn't admit to the full amount for ages.

I would love to have my BR annulled and pay what I owed, but I would only do it if Dave offered me the money - why should he pay for my debts?

That is not always the case to be honest....all my debts were just that - my debts...in fact i never told hubby about the larger ones as i did not want him to worry, he only found out just before i decided to go br.

I must say though i would want to get my BR annuled, pay what i owe off and carry on knowing that i did the right thing for me.

If Dave won the lottery I wouldn't ask him to clear my debts, as simple as that. I was the one that spent the money, not him, so I wouldn't expect him to pay a penny towards my debts, as although we were seeing each other, most of them were accumulated before I lived with him.

If he'd won a lot of money and offered to pay the debts for me then I would say yes.

Hi Barrel and welcome

Really if you win a reasonable amount then you should contact your OR and explain this to them as if you can clear your creditors and also the fees that have accumulated from the BR then that is clearly the best way to go.

I presume your thinking as the BR that may have won. It is the right thing to clear off your creditors and that would also give you a clear mind and you can then have your BR annuled.

If you dont inform the OR and you won the money then it could be seen as unfavourable at least up until discharge.

My conscience would make sure that i informed them and hopefully clear my name and my debts.

When it comes to the non BR spouse which is where this post started then its sligthly different.

Again its really a case of conscience and i would rather have a clear one.

I thought an IPA is only on your income, if you win the lottery, I thought you can keep it as it did not derived from a job.Thoughts please

You had the credit so why not pay back? Also, not all creditors will be banks, some might be employess as one person has posted about.

Officially this is what would happen assuming you are BR but your wife isn't.

You are meant to inform the OR if someone in your household starts to contribute more to the household budget. If, say you are now contributing £800 and your wife is putting in £800 you need to put your wife's contribution down as 'other income' on the form. Obviously, if your wife wins and starts contributing £7 million (assuming a roll over win!) there might just be a little bit of money to pay off your debts (assuming they are in the region of 50-100k). The OR would be interested. He should, however, not demand the ticket from you because your wife has won. Lets face it, if she wins the lotto it will be no skin off your teeth to pay off your debts (plus OR fees, of course - which should be no more than 5-10k) and get your BR annulled.

the decision whether or not to pay off your debts once bankrupt and after a lottery win is obviously one of individual choice.

As far as I can see, for me, I see little point.
I did nothing morally wrong by declaring bankruptcy so don't particulary feel morally obliged to put it right. I don't want my bankruptcy annulled because I don't want credit ever again.

As far as the creditors are concerned they reclaimed their money through their own insurance cover long ago.

Just my view but I'd rather spoil the family or donate some money to good causes.
Banks are bottom of my list.

And no I haven't won the lottery yet either.

What a wonderful thought to win on the lottery. If you bought the winning ticket then there is no proof that you bought it and someone you could trust could claim the winnings and keep it for you. If your wife bought the winning ticket and claimed the money then I would have thought she would be entitled to the money. Remember you have gone bankrupt not your wife.

I know this sounds a bit sneaky but how many bankrupt people who won on the lottery would not claim the money themselves?

If I won a million I would probably pay my debts out of it for a clear conscience, and the money left over would probably be enough to keep me for the rest of my days if I was careful.
