got there Posted - 28 November 2008 : 11:16:34
Finally got house sorted moving dated of the 30 January 2009. House is lovely, would have liked to be in for xmas but at least we havent got all the upheaval before xmas.

We paid 2k deposit and will be paying monthly, so there is hope out there for anyone looking for a rental house after BR.

With the voluntary repossessions how do the utility bills work do you tell them details the same as just moving or do they need extra stuff like mortgage company etc.

Would be grateful for advice from anyone who has already done this.

I will be moving back in with hubby after 6 months apart, told OR went BR because of split which it was, will they be funny with me cause getting back together??

Thanks again.

My story is such a tangled web, even our OR just said to leave the house to be repossessed, he had no interest in it at all as there was about £30,000 negative equity at the time we went bankrupt, and now, because it took so long to be repossesed and then sold, the shortfall is nearly £70,000. There is now a shortfall to NRock of over £30,000 and the whole amount we owed on a secured loan of £36,000 and selling costs, mortgage arrears and interest

In the end, it did not matter with regards the council house as they never even asked about it

The council house folks really just need to see documents giving you a posession / reposession and ultimately an eviction date. Once that is provided and you are out always give the house back.

If nothing else it minimises the debt in Br and would ultimately look better.

We did not pay NR anything, I told them numerous times of the situation and they just kept saying, "we will repossess it ASAP" and they didnt!

Just tell the utility companies of your moving date and final meter readings should be taken in the day you go.

Just a word of warning about what happened to me with Council Tax.

We left our house for repossession, moved into a rented house before bankruptcy. We were told that as we technically still owned the house, we had to pay half the Council Tax and the council tax on the rented house We explained what was happening and were awarded a Class C exemption for repossessed houses, but this only lasts for 6 months. We left our house and it was 13 MONTHS before NRock got around to repossessing it, so even though we were bankrupt, we were billed for the remaining 7 months council tax

Now, our OR was less than helpful and said we had to pay it, I argued with the council and found some info on the internet that said the house should have been awarded a Class Q exemption, for a house left by a bankrupt. I had to pay the bill in the end but I won on appeal and got the money refunded.

In hindsight, I really wish now that we had just handed the house back straightaway but we were advised by CAB to leave it to be repossessed as that way, we would not prejudice our chances of getting a council house, not the best advise, I can see that now. By the way, we did get a council house eventually
